These Terms and Conditions govern your use of the Phoenix Rest website and the residential care arrangements offered by Phoenix Rest at 56 Fuk Tsun Street, Tai Kok Tsui, Kowloon, Hong Kong. By using our website or entering into any arrangement with us, you agree to these terms.
1. Definitions
In these Terms and Conditions:
- "The Home" / "We" / "Us" refers to Phoenix Rest, operated at 56 Fuk Tsun Street, Tai Kok Tsui, Kowloon, Hong Kong.
- "Resident" refers to the elderly individual who occupies or uses any arrangement offered by Phoenix Rest.
- "Family Representative" refers to the person or persons who act on behalf of a resident, including in arrangements and communications with the Home.
- "Arrangement" refers to any service agreed between the Home and a resident or their representative, including Full Residence, Afternoon Leisure Sessions, and Respite Care Weekends.
- "Website" refers to the online presence of Phoenix Rest accessible at https://phoenixrest.pro
2. Acceptance of Terms
By using this website or entering into any arrangement with Phoenix Rest, you confirm that you are at least 18 years of age and have the legal capacity to enter into an agreement. If you are acting on behalf of a resident, you confirm that you are authorised to do so.
3. Our Services
Phoenix Rest provides non-medical residential care for elderly individuals in Hong Kong. Our services include:
- Full Residence Arrangement: continuous residential stay with meals, activities, housekeeping, laundry, and companion presence.
- Afternoon Leisure Sessions: structured afternoon programme, three times per week, including activities, light meal, and companion support.
- Respite Care Weekend: a two-night Friday-to-Sunday stay with meals, activities, and companion care.
Phoenix Rest does not provide medical, nursing, or clinical care. Residents or families with medical care requirements should seek appropriate healthcare providers separately.
4. Arrangements and Bookings
All arrangements are confirmed in writing between the Home and the family representative. An arrangement is considered confirmed once both parties have agreed on the start date, fees, and any specific requirements.
Phoenix Rest reserves the right to decline or discontinue an arrangement where the needs of a resident exceed what the Home is able to safely provide.
5. Fees and Payment
Current fees are as follows:
- Full Residence: HK$13,900 per calendar month
- Afternoon Leisure Sessions: HK$1,850 per month (three afternoons per week)
- Respite Care Weekend: HK$2,100 per weekend stay
Fees are payable in advance at the beginning of each month or before each weekend stay, as applicable. Phoenix Rest accepts payment by bank transfer or such other methods as agreed at the time of arrangement. Fees are stated in Hong Kong Dollars (HKD).
We reserve the right to revise fees with reasonable advance notice. Any changes will be communicated to existing residents or their representatives no less than one calendar month before taking effect.
6. Cancellation and Refund Policy
Full Residence
Either party may end a Full Residence arrangement with one calendar month's written notice. Where a resident departs with shorter notice, the corresponding portion of the monthly fee may be retained by the Home to cover costs already incurred.
Afternoon Leisure Sessions
Monthly fees for leisure sessions are non-refundable once the month has commenced. Sessions missed due to a resident's absence or illness will not be credited.
Respite Care Weekend
Cancellation of a weekend stay with at least 72 hours' notice will receive a full refund. Cancellations within 72 hours of the Friday arrival may incur a charge of 50% of the weekend fee to cover staffing and preparation costs.
7. Resident Responsibilities
Residents and their family representatives are asked to:
- Provide accurate and complete information about the resident's needs and preferences before or upon arrival
- Notify the Home of any changes in health or circumstances that may affect care arrangements
- Respect the Home's environment and the wellbeing of other residents and staff
- Ensure that personal items brought into the Home are clearly labelled and that no items posing a risk to others are introduced
8. Prohibited Conduct
Residents, family visitors, and other guests are asked not to engage in behaviour that disrupts the calm and respectful environment of the Home. The Home reserves the right to request that a visitor leave the premises if their conduct is disruptive or distressing to residents or staff.
9. Liability
Phoenix Rest takes reasonable steps to maintain a safe and comfortable environment. However, the Home does not accept liability for:
- Loss or damage to personal property belonging to residents or visitors
- Incidents arising from a resident's pre-existing health conditions
- Events beyond the reasonable control of the Home, including force majeure situations
Families are encouraged to maintain appropriate insurance for their relative's personal belongings.
10. Intellectual Property
All content on this website โ including text, design, and images โ is the property of Phoenix Rest or its licensors. You may not reproduce, copy, or distribute any content without prior written consent.
11. Privacy
Your personal data is handled in accordance with our Privacy Policy, which forms part of these Terms and Conditions.
12. Termination
The Home may terminate an arrangement with reasonable notice if a resident's care needs change beyond what the Home can safely provide, or if these Terms and Conditions are materially breached. In urgent situations, where a resident's safety or the safety of others is at risk, the Home may act with shorter notice.
13. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Hong Kong Special Administrative Region. Any disputes arising from these terms or from the use of our services shall be subject to the non-exclusive jurisdiction of the courts of Hong Kong.
Phoenix Rest encourages informal resolution of any concerns before formal proceedings are pursued. Families are welcome to raise concerns directly with the Home Director at any time.
14. General Provisions
If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will continue to apply. Failure by Phoenix Rest to enforce any provision at a given time does not constitute a waiver of that provision.
15. Changes to These Terms
Phoenix Rest may update these Terms and Conditions from time to time. Updated terms will be posted on this page with a revised date. Continued use of our website or services after changes are published constitutes acceptance of the updated terms. For significant changes affecting existing arrangements, we will notify family representatives directly.
